1. Purpose and applicable legislation

TOKY MEDIA NETWORKS, S.L. (“TOKY MEDIA”), owner of the Tokyvideo video-sharing platform, publishes this notice to ensure transparency for users regarding the use of Artificial Intelligence (“AI”) systems in images and videos hosted and made available to the public through the platform, in accordance with Article 50 of Regulation (EU) 2024/1689 of the European Parliament and of the Council of June 13, 2024, laying down harmonized rules on artificial intelligence (“AI Act”), whose transparency obligations apply from August 2, 2026.

This notice is also interpreted and applied in light of the European Commission Guidelines on the transparency obligations under Article 50 of the AI Act and the European Union’s Code of Practice on Transparency of AI-Generated Content, as well as Regulation (EU) 2022/2065 of the European Parliament and of the Council of October 19, 2022, on a Single Market for Digital Services (“DSA”), and Law 13/2022 of July 7, on General Audiovisual Communication, insofar as it applies to video-sharing platform service providers.

2. Labeling of AI-generated or AI-manipulated audiovisual content

Not all content on Tokyvideo has been generated or processed using AI. Images and videos whose generation, editing or manipulation involves AI systems in a way that may alter their content, and in particular those constituting deepfakes, will be clearly, visibly and distinguishably identified and labeled as such, no later than the user’s first exposure to the content, in accordance with Article 50 of the AI Act, under the following two scenarios:

a) Content uploaded by users. The user uploading content to the platform is responsible for identifying and labeling it where AI has been used, at the time of upload, through the tools made available by the platform for this purpose or, where such tools are not available, by clearly indicating this in the title and description of the video. If the content is not properly labeled, TOKY MEDIA may label it, remove it or disable access to it, without prejudice to the notice-and-action procedures provided for under the DSA and the platform’s Terms and Conditions.

b) Content made available by the platform itself. Images, thumbnails, promotional materials and videos produced by Tokyvideo will be identified and labeled by those responsible for AI at TOKY MEDIA.

Where AI-generated or AI-manipulated content is included in a work or program that is clearly artistic, creative, satirical, fictional or similar in nature, the labeling need only disclose the presence of such content in a manner appropriate to the work and without detracting from its presentation or enjoyment. The labeling requirement does not apply to standard editing functions used solely as assistive tools where they do not materially alter the content.

3. Reporting unlabeled content

Any user or third party who identifies AI-generated or AI-manipulated content on Tokyvideo that has not been properly labeled may report it through the platform’s notice-and-action mechanism pursuant to Article 16 of the DSA, through the “Contact” link or using the email address indicated in Section 5.

TOKY MEDIA will process such reports diligently, objectively and in a non-arbitrary manner and, where appropriate, will take the measures set out in Section 2(a).

4. Identification and labeling mechanisms

TOKY MEDIA may implement automated or non-automated mechanisms on the platform to identify and label content generated or manipulated using AI, including the reading of machine-readable markings or provenance metadata incorporated by providers of AI systems.

These mechanisms may be adapted over time to reflect technological developments and relevant industry codes of practice.
